1. Acceptance of Terms

By accessing and using SpeakNetic ("the Service"), an AI-powered language learning platform that provides real-time conversations with AI tutors, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by these terms, please do not use this service.

SpeakNetic provides English language learning through real-time AI conversations available 24/7. The Service includes voice and text conversations, instant feedback, and personalized learning paths.

2. Service Description and License

SpeakNetic provides access to AI-powered language learning services, including real-time conversations with AI tutors. You are granted a limited, non-exclusive, non-transferable license to use the Service for personal language learning purposes. Under this license you may not:

• Use the Service for any commercial purpose, including teaching, tutoring, or reselling access
• Attempt to reverse engineer, decompile, or extract AI models or algorithms
• Record, reproduce, or redistribute AI tutor conversations without permission
• Use automated systems, bots, or scripts to interact with the AI tutors
• Share your account credentials or allow others to use your account
• Use the Service in any way that violates applicable laws or regulations

3. User Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. You are responsible for safeguarding the password and for all activities that occur under your account.

You agree not to disclose your password to any third party and to take sole responsibility for any activities or actions under your account, whether or not you have authorized such activities or actions.

4. Acceptable Use

You agree not to use the Service:

• In any way that violates any applicable national or international law or regulation
• To transmit harmful, abusive, offensive, or inappropriate content during conversations with AI tutors
• To attempt to manipulate, exploit, or abuse the AI system
• To transmit, or procure the sending of, any advertising or promotional material without our prior written consent
• To impersonate or attempt to impersonate the company, a company employee, another user, or any other person or entity
• In any way that infringes upon the rights of others, or in any way is illegal, threatening, fraudulent, or harmful
• To generate content that could be used for academic dishonesty, cheating, or plagiarism

The Service is designed for legitimate language learning purposes. Misuse of the AI conversation features may result in account suspension or termination.

5. Service Availability and Pricing

Service Availability: We strive to provide 24/7 access to AI conversations, but we reserve the right to withdraw or amend the Service, and any service or material we provide on the Service, in our sole discretion without notice. We will not be liable if, for any reason, all or any part of the Service is unavailable at any time or for any period.

Pricing: Our pricing is as follows:

• Pay-as-you-go: $3 per hour of AI conversation time
• Monthly Plans: Various subscription plans with included hours and additional hours at $3/hour
• Pricing is subject to change with 30 days notice to existing subscribers
• Conversation time is measured from when you start a conversation until you end it
• Unused hours in monthly plans do not roll over to the next billing period unless otherwise stated

Refunds: Refunds for unused conversation time may be available on a case-by-case basis. Contact us at contact@speaknetic.com for refund requests.

6. Intellectual Property

The Service and its original content, features, AI models, algorithms, and functionality are and will remain the exclusive property of SpeakNetic and its licensors. The Service is protected by copyright, trademark, and other laws.

Your Content: You retain ownership of the content you create during conversations (your speech, text inputs). However, by using the Service, you grant SpeakNetic a license to use, process, and analyze your conversation content to provide the language learning service, improve our AI, and generate learning insights.

AI Responses: AI-generated responses, feedback, and content are provided for your personal learning use only and may not be reproduced, distributed, or used for commercial purposes.

7. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

8. AI Service Disclaimers

AI Nature of Service: SpeakNetic uses artificial intelligence to provide language learning conversations. You understand and agree that:

• The AI tutors are automated systems and not human tutors
• AI responses are generated by algorithms and may occasionally contain errors or inaccuracies
• While we strive for accuracy, AI feedback on pronunciation, grammar, and vocabulary should be used as a learning tool, not as absolute authority
• The Service is designed for language learning practice and should not replace professional language instruction when needed
• AI conversations may not always perfectly simulate real-world situations

Learning Outcomes: We do not guarantee specific learning outcomes or language proficiency levels. Your progress depends on various factors including practice frequency, effort, and individual learning capacity.

9. Limitation of Liability

In no event shall SpeakNetic, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Service.

This includes, but is not limited to, any issues arising from AI-generated content, conversation quality, learning outcomes, or service interruptions.

10. Governing Law

These Terms shall be interpreted and governed by the laws of the jurisdiction in which SpeakNetic operates, without regard to its conflict of law provisions.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. Continued use of the Service after changes constitutes acceptance of the new terms.

Changes to pricing will be communicated with at least 30 days notice to existing subscribers.
